Welcome to WalshySells. These Terms of Service ("Terms") govern your use of the WalshySells website and your purchase of products from WalshySells.

By accessing our website, placing an order, or purchasing a product from WalshySells, you agree to these Terms. If you do not agree with these Terms, please do not use our website or place an order.

1. General Terms

WalshySells operates an online store offering Pokémon Trading Card Game products and other collectible products and merchandise.

We reserve the right to refuse service, cancel orders, limit quantities, or restrict purchases when reasonably necessary, including in cases of suspected fraud, pricing errors, product availability issues, misuse of the website, or violations of these Terms.

You may not use our website or products for any unlawful purpose or violate any applicable laws while using our services.

2. Products and Availability

We make reasonable efforts to accurately display product descriptions, images, pricing, availability, and other information.

Product packaging, appearance, and other details may vary from images shown on our website due to manufacturer changes or differences between production runs.

All products are subject to availability. Adding an item to your cart does not guarantee availability or reserve the item until your order has been completed.

We reserve the right to limit the quantity of any product purchased by a customer.

3. Pricing

Prices are displayed in U.S. dollars unless otherwise stated.

WalshySells reserves the right to change product prices at any time without prior notice. Price changes do not affect orders that have already been completed unless an obvious pricing or technical error occurred.

Discount codes, promotions, rewards, and other offers may be subject to additional restrictions and expiration dates.

4. Orders

After placing an order, you may receive an order confirmation. An order may still be canceled or refunded by WalshySells if we discover an inventory error, pricing error, suspected fraudulent transaction, shipping issue, or another circumstance that prevents us from fulfilling the order.

Customers are responsible for providing accurate billing, shipping, and contact information.

WalshySells is not responsible for delays or delivery problems caused by incorrect or incomplete information provided by the customer.

5. Refund and Return Policy

ALL SALES ARE FINAL.

Due to the collectible nature of Pokémon TCG products and to protect our customers from the possibility of product tampering, resealing, weighing, searching, alteration, or other interference, WalshySells does not accept returns or exchanges.

This policy applies even when a product remains unopened after delivery. Once a product leaves our possession, we cannot independently verify how it was stored or handled. Accepting returned collectible products could prevent us from guaranteeing the same level of product integrity to future customers.

Our no-return policy helps ensure that products sold by WalshySells have remained within our controlled supply and fulfillment process and have not previously been returned by another customer.

Nothing in these Terms is intended to limit any rights or remedies that cannot legally be limited under applicable Law.

6. Damaged, Missing, or Incorrect Orders

If an order arrives damaged, contains an incorrect product, or is missing an item, please get in touch with WalshySells as soon as reasonably possible after delivery.

Customers should provide:

• Their order number
• A description of the problem
• Clear photographs of the product
• Photographs of the shipping packaging when applicable

WalshySells will review the circumstances and determine an appropriate resolution.

If WalshySells made an error in fulfilling an order, we will work to correct the issue at no additional cost to the customer.

A resolution may include, when appropriate, replacement, store credit, refund, or another reasonable solution.

7. Opened and Randomized Products

Opened Pokémon TCG products and other opened collectible products are non-returnable and non-refundable, except where otherwise required by Law.

WalshySells cannot provide a refund or exchange solely because of:

• Cards or items pulled from a product
• Pull rates
• Card rarity
• Card value
• The customer's satisfaction with the contents
• Card grades or potential grades
• Variations in randomized product contents

Pokémon TCG products contain randomized contents unless otherwise stated. Purchasing a sealed product does not guarantee that it will contain any particular card, rarity, value, or number of desirable cards.

WalshySells does not guarantee pull rates, card grades, or resale values.

8. Manufacturer Issues

Factory-sealed products are manufactured and packaged by their respective manufacturers.

Certain issues involving the contents of an otherwise authentic factory-sealed product may be outside the control of WalshySells.

Where appropriate, customers may need to contact the product manufacturer regarding manufacturing defects, packaging errors, or issues involving factory-sealed contents.

This section does not limit any rights that customers may have under applicable Law.

9. Order Cancellations

If you would like to cancel an order, contact WalshySells as soon as possible.

Cancellation requests are not guaranteed.

Once an order has been processed, packed, handed to a shipping carrier, or shipped, we may be unable to cancel it.

WalshySells reserves the right to cancel an order before fulfillment when reasonably necessary and issue any applicable refund.

10. Shipping and Delivery

Shipping estimates are estimates and are not guaranteed delivery dates unless specifically stated otherwise.

WalshySells is not responsible for delays caused by shipping carriers, weather, natural disasters, incorrect addresses, or circumstances outside our reasonable control.

Customers are responsible for reviewing their shipping address before completing an order.

If a package is returned to WalshySells because the customer provided an incorrect or incomplete address, additional shipping charges may apply before the order can be shipped again.

11. Lost or Stolen Packages

If tracking indicates that a package has been lost in transit, please get in touch with WalshySells so that we can review the shipment and, when appropriate, work with the shipping carrier.

If a carrier marks a package as delivered but the customer cannot locate it, the customer should contact the carrier and WalshySells as soon as possible.

WalshySells will make reasonable efforts to assist with shipping issues but cannot guarantee reimbursement for packages stolen after confirmed delivery, except where required by applicable Law.

12. Product Authenticity

WalshySells takes product authenticity seriously.

We aim to sell authentic products obtained through sources we believe to be legitimate and reliable.

Our no-return policy is partially intended to maintain the integrity of this process by preventing customer-returned collectible products from being placed back into inventory where their handling can no longer be independently verified.

13. Resale and Product Value

Collectible products may increase or decrease in market value after purchase.

WalshySells does not guarantee the future value, resale value, investment performance, collectibility, or market price of any product.

Changes in market price after an order is placed do not create a right to a refund, return, price adjustment, or cancellation.

14. Promotions and Discount Codes

WalshySells may occasionally provide promotional codes, sales, giveaways, rewards, or other offers.

Promotions may have separate terms and may be changed or discontinued when permitted by Law.

Unless otherwise stated, discounts cannot be combined.

Abuse of promotional codes, referral programs, rewards, or other offers may result in cancellation of the discount, order, or associated benefits.

15. Fraud and Chargebacks

Customers should contact WalshySells if they believe there is a problem with an order so that we have an opportunity to investigate and resolve the issue.

Fraudulent purchases, intentionally false claims, payment abuse, or other fraudulent activity may result in an order being canceled or future purchases being refused.

Nothing in this section prevents a customer from exercising legitimate rights provided by their bank, card issuer, payment provider, or applicable Law.

16. Intellectual Property

The WalshySells name, original website content, graphics, logos, photographs, and other original materials belonging to WalshySells may not be copied, reproduced, distributed, or commercially used without permission, except as permitted by Law.

Third-party trademarks, product names, characters, logos, and other intellectual property remain the property of their respective owners.

WalshySells is an independent retailer and is not affiliated with, sponsored by, or endorsed by The Pokémon Company, Nintendo, Game Freak, or Creatures Inc. unless expressly stated otherwise.

17. Website Use

You agree not to interfere with the operation or security of the WalshySells website.

Prohibited activity includes attempting to gain unauthorized access to the website or customer information, introducing malicious software, using the website for fraudulent purposes, or intentionally interfering with its operation.

18. Limitation of Liability

To the fullest extent permitted by applicable Law, WalshySells will not be liable for indirect, incidental, special, or consequential losses arising from the use of our website or products.

Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited.

19. Changes to These Terms

WalshySells may update these Terms of Service from time to time.

The most current version will be posted on our website with an updated revision date. Your continued use of the website after changes become effective constitutes acceptance of the updated Terms to the extent permitted by applicable Law.

20. Governing Law
